Bayer Pharmaceuticals Hit with Yaz and Yasmin Lawsuits

 

The United Kingdom consists of three legal jurisdictions. That of England and Wales and  Northern Ireland Law are based on common law principles. The other jurisdiction is Scots Law which dates back to the Middle Ages and consists of civil law principles with some common law elements.

Legal System

In England and Wales the legal system is headed by The Supreme Court of England and Wales which resides in the Royal Courts of Justice in London. This body is made up of three institutions. The Crown Court, which deals with criminal  cases. The High court of Justice for civil cases, and the Court of Appeal. In English Law, the highest body of appeal is the Law Lords in the House of Lords.

Unlike the USA the UK does not have a written constitution, but is a member state of the European Union and subject to it’s laws. The Human Rights Act incorporates the European Convention on Human Rights into UK Law.

Legal Entry

Entry into the UK legal system is commonly achieved through studying for an undergraduate law degree followed by a year long professional course and examination. The Academic stage mainly focuses on the analysis of legal texts and the learning of legal principles. The Vocational period has in recent times turned it’s attention to providing practical experience of the attributes, knowledge and application that will be needed as a practicing lawyer.

Bayer Pharmaceuticals Hit with Yaz and Yasmin Lawsuits

Yaz is a highly popular birth control pill. It is used by millions of women across the globe and has made millions of dollars. Yaz along with its sister birth control pill, Yasmin, is manufactured by Bayer HealthCare Pharmaceuticals. These pills have made recent headlines due to their potentially fatal side effects and the Yaz Lawsuit they are now facing .

Yaz and Yasmin are newer types of oral contraceptives. They are comprised of drospirenone, a synthetic progestin, and ethinyl estradiol. These two ingredients are linked to severe and potentially fatal side effects. Some of these side effects include heart problems and gallbladder diseases. In extreme cases, patients have had their gallbladders removed. Drospirenone is linked to life threatening blood clots, liver and kidney damage.

Side Effects

The side effects of Yaz and Yasmine have resulted in numerous lawsuits being filed against Bayer Healthcare Pharmaceuticals. Suits have been filed in Pennsylvania, New Jersey and a host of other states. There have been close to 4,000 lawsuits have been filed against Bayer Healthcare in Illinois. Chances are more lawsuits will be filed against the pharmaceutical giant.

California also has several Yaz and Yasmin lawsuits pending. In the Superior Court of Riverside, California, four plaintiffs are alleging that they have suffered as a result of the birth controls’ side effects. Their health issues include pulmonary embolism, hearth and lung damage. They are seeking compensatory and punitive damages. In Los Angeles, eleven people have filed lawsuits on health issues that occurred after taking Yaz or Yasmin.

Los Angles Case

The lawyer representing the case in Los Angeles is suing Berlex Laboratories as well as Bayer. Berlex Labs originally introduced Yaz and Yazmin to the market. Bayer acquired Berlex in 2006. Three of the plaintiffs, Dakota Terral and Sophia Brown, suffered from pulmonary embolism. They were treated in time. A third plaintiff also suffered from a pulmonary embolism but did not survive.

All of the lawsuits are stating a common grievance. The plaintiffs are claiming that Bayer is negligent for not offering adequate warning about the known side effects. They also accuse the pharmaceutical company of marketing a dangerous product. There are many studies that confirm the link between Yasmin and the occurrence of dangerous blood clots.

Every plaintiff that has filed a lawsuit is suing for compensatory damages to cover medical expenses, pain and suffering and lost wages. The lawsuits are also requesting punitive damages.
